    Terms of service.

    This document establishes the overarching legal framework for all marketing assets assignments. Marketing Assets includes (and not limited to): Photography, Videography, Drone, Floor Plan, Virtual Tour. These Terms of Service, in conjunction with any specifically issued project quote, estimate, or invoice, constitute the complete contract between Photerior Ltd (we, us), registered company number 13826377, and the Client (you). By booking a job through Photerior, or commencement of work, or payment of any deposit, signifies acceptance of these terms.

    1. Scope, fees & late payments

    All services are delivered according to the specific brief, image parameters, and deliverables detailed as per the fees on the Photerior portal. Fees must be fulfilled according to the agreed milestone structure. Late Payments: Invoices remaining unpaid past the explicitly stated deadline will be deemed overdue. Photerior retains sole discretion to apply a 2% compound interest charge to the total outstanding balance, calculated continuously from the exact due date until complete remuneration is processed. Travel Expenses: Any initial quote for travel expenses is estimated. The final fee will be provided upon invoice.

    2. Copyright ownership & usage licensing

    Photerior retains sole, exclusive, and perpetual intellectual property copyright over all images produced under law. Standard Usage Scope: Deliverables are strictly restricted to the commercial usage parameters defined on the quote. Baseline authorisation is restricted to the Client's direct digital media and internal corporate communications. Third-Party Restrictions: Clear, explicit written agreement must be obtained from Photerior prior to distributing, sharing, or publishing any images with third parties (including subcontractors, corporate partners, external agencies, or adjacent vendors). Anyone found to have disseminated files without prior written consent will be subject to an additional charge matching standard independent licensing rates per image.

    3. Logistics & at-location representation

    The Client assumes all responsibility for obtaining mandatory location permissions, venue permits, properties access rights, and underlying legal clearances necessary to complete the assignment safely. All logistical and site information pertinent to the job must be shared, via email, with Photerior at least 24 hours before the job taking place. At-Location Representative: It is beneficial to have a designated representative present at the location during the physical assignment to guide, verify, and approve creative direction, composition layout and styling choices. However, if no authorised corporate representative is present at the location, the Client explicitly agrees to accept Photerior's creative and technical judgment as final, waiving rights to reject deliverables based on visual style or aesthetic preference.

    4. Post-production, artistic style & revisions

    The Client acknowledges familiarity with Photerior's professional portfolio and agrees to accept their creative aesthetic and post-processing style. Included Revisions: One round of editing and minor adjustments is included within the quoted cost. Any additional conceptual alterations, secondary feedback adjustments, or advanced structural manipulation (such as advanced object deletion, detailed skin modification, or environment changes) will be billed accordingly at current standard hourly production rates.

    5. Cancellations, rescheduling & on-site obstruction

    Cancellations and modifications will be charged at the discretion of Photerior as follows. Under 24 Hours Notice: Cancellations or structural rescheduling requests submitted less than 24 hours prior to the set shoot time will automatically incur a 50% charge of the total project quote, alongside all non-refundable operational expenses already realised. On-Site Cancellation / No Access: If the Photographer arrives at the location and the job must be abandoned, postponed, or rescheduled due to lack of venue readiness, client delays, or no access to the premises, a 100% charge of the total quoted project fee will apply instantly. Adverse Weather: If adverse weather compromises conditions on the day and it is mutually agreed to reschedule, no cancellation charge will be applied. However, if the shoot proceeds to completion and the Client requests the Photographer to revisit the location on a separate day due to weather modifications or aesthetic preferences, an independent additional charge will apply.

    6. Aerial (drone) operations

    All unmanned aerial vehicle operations are governed strictly by regional civil aviation authority frameworks and environmental conditions. Restricted Zones: Flight paths are subject to meticulous pre-flight airspace assessments. If a site sits within a Flight Restriction Zone (FRZ) or restricted airspace, the flight will not proceed unless official regulatory clearance is secured. If operations are blocked due to local airspace regulations, Photerior is not liable for missing aerial deliverables, and standard rates apply for all concurrent ground work. Upon booking of the job, Photerior will check if a FRZ is applicable, and will check again 24 hours prior to the job taking place. Where possible, the Client should also check if there are any restrictions in place. Weather Grounding & Safety: The Photographer acts as Pilot in Command and holds final, absolute authority over flight safety. Operations are grounded during heavy wind, rain, snow, or low visibility. If a drone flight is grounded due to weather, it will be rescheduled at a mutually convenient date under standard Adverse Weather terms for no added fee.

    7. Associate sub-contracting & continuity

    In the exceptional event that the primary photographer becomes unavailable due to unexpected medical emergency, sudden illness, or force majeure events, Photerior reserves the right to sub-contract the assignment to an associate photographer. Any contracted professional will operate under the strict guidance, creative brief, and technical parameters of the primary photographer. All raw media assets will undergo standard internal editing and rigorous quality-control checks before distribution to maintain complete brand consistency.

    8. Limitations of liability

    In the highly unlikely event of complete equipment failure, digital corruption, physical theft, or data loss, the Photographer's maximum liability is limited strictly to a complete refund of all monies paid for that specific project. The Photographer cannot be held liable for any secondary, speculative, or consequential business losses or damages. These standard Terms of Service apply directly to any project proposal, quotation, or invoice authorised by the client.
